Terms and Conditions

These terms govern your use of this website and the sale of products and services by NESCHEM. Where we have signed a separate supply agreement with you, that agreement takes precedence to the extent the two differ.

Orders and acceptance

An order placed on this website is an offer to buy. It becomes a contract when we confirm it, not when you submit it. We may decline an order — for example where stock has run out, where a price was listed in error, or where we are not satisfied that the product may lawfully be supplied to you.

Prices and tax

Prices are shown in the currency stated at checkout and exclude VAT unless the page says otherwise. VAT is calculated and shown separately before you confirm the order. Prices can change without notice, but the price confirmed on your order is the price you pay for that order.

Payment

Unless you hold approved credit terms with us, orders are paid before despatch. Goods are released once payment has cleared into our account, which for a bank transfer is not the same moment the transfer is made. Approved account customers are invoiced on the terms agreed with them.

Delivery and collection

Delivery timescales given at checkout are estimates, not guarantees, and depend on the destination and on the classification of the goods. Risk in the goods passes to you on delivery, or on collection if you collect. Title passes when the goods have been paid for in full.

Please check every consignment on arrival. Shortages or damage in transit must be reported to us within three working days.

Specification and suitability

Products are supplied to the specification shown on the product page, and a certificate of analysis is available for each batch. We give technical guidance in good faith and on the information you provide, but you remain responsible for satisfying yourself that a product is suitable for your process, your equipment and your application.

Safety, handling and your obligations

Chemical products are sold for use by competent persons with appropriate facilities, training and protective equipment. By ordering you confirm that this is the case.

A safety data sheet is available for every product and is supplied with each consignment. You are responsible for reading it, for storing and handling the product in accordance with it, for training the people who will handle it, and for disposing of the product and its packaging lawfully.

Restricted and controlled products

Some products cannot be bought online and are marked accordingly. These are supplied only against a valid permit and, where required, a signed end-use declaration. We may ask for evidence of intended use for any order, and we may decline to supply where that evidence is not provided.

Cancellation and returns

An order may be cancelled at no charge at any time before despatch. Once goods have left our premises, chemical products cannot be returned for credit unless the seal is unbroken, the packaging and labelling are intact, and we have agreed the return in advance in writing. Opened containers and special or non-stock items are not returnable.

None of the above limits your rights where goods are defective, are not of the specification ordered, or were supplied in error. Tell us and we will replace them or refund you.

Warranty and liability

We warrant that goods will meet the stated specification at the point of delivery. Because we have no control over how a product is stored, handled or applied after that point, our liability in connection with any order is limited to the price paid for that order. We are not liable for indirect or consequential loss, including loss of profit, production or contracts. Nothing in these terms limits liability that cannot lawfully be limited, including liability for death or personal injury caused by our negligence.

Use of this website

You may browse and use this website for lawful purposes. You may not attempt to gain unauthorised access to any part of it, submit automated or abusive form submissions, or reuse its content commercially without written permission. You are responsible for keeping your account password confidential.

Governing law

These terms are governed by the laws of Zimbabwe. They may be updated from time to time; the version published on this page when you place an order is the version that applies to that order.
